1. Agreement to Terms

By accessing or using RankTack ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

RankTack is operated by RankTack ("we", "us", or "our"). We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Description of Service

RankTack is an AI-powered SEO content automation platform that helps e-commerce stores generate, schedule, and publish SEO-optimized content. Our Service includes:

• AI-powered article generation optimized for search engines and AI platforms
• Keyword research and discovery tools
• Content scheduling and calendar management
• Direct publishing to Shopify and WordPress platforms
• Backlink tracking and monitoring
• Competitor analysis and research

3. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

You must be at least 18 years old to use the Service. By creating an account, you represent that you meet this requirement.

4. Subscription and Billing

RankTack offers subscription-based access to the Service:

• Trial: New users receive a limited trial with 3 credits and 1 site
• Monthly Plan: $99 per site per month with 60 credits
• Yearly Plan: $67 per site per month (billed annually) with 720 credits

Credits are used for article generation and publication. Unused credits do not roll over between billing periods. Subscription fees are non-refundable except as required by law.

Payment processing is handled by Stripe. By subscribing, you agree to Stripe's terms of service and authorize recurring charges to your payment method.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Generate content that is defamatory, obscene, or harmful
• Spam, phish, or distribute malware
• Interfere with or disrupt the Service or its infrastructure
• Attempt to gain unauthorized access to any systems or data
• Resell or redistribute the Service without authorization
• Use automated means to access the Service beyond normal usage

6. AI-Generated Content

Content generated by RankTack is created using artificial intelligence and is provided "as is". You acknowledge that:

• AI-generated content may require review and editing before publication
• You are solely responsible for content published to your websites
• We do not guarantee rankings or traffic improvements
• Generated content may not be unique across all users
• You must ensure published content complies with applicable laws and platform policies

You retain ownership of content published to your platforms. By using the Service, you grant us a license to process your data for the purpose of providing the Service.

7. Third-Party Integrations

The Service integrates with third-party platforms including Shopify and WordPress. By connecting your accounts:

• You authorize us to access and publish content on your behalf
• You are responsible for compliance with those platforms' terms of service
• We are not responsible for changes to third-party APIs or services
• Your credentials are stored securely and used only for publishing

8. Intellectual Property

The Service, including its design, features, and technology, is owned by RankTack and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

"RankTack" and associated logos are trademarks of RankTack. You may not use our trademarks without prior written consent.

9. Limitation of Liability

To the maximum extent permitted by law, RankTack and its affiliates shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Service interruptions or errors
• Actions of third-party services or integrations

Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.

11. Indemnification

You agree to indemnify and hold harmless RankTack, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Content you publish using the Service
• Your violation of these Terms
• Your violation of any third-party rights

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination:

• Your right to use the Service ceases immediately
• We may delete your data after a reasonable retention period
• Provisions that should survive termination will remain in effect

You may cancel your subscription at any time through your account settings or by contacting support.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which RankTack operates, without regard to conflict of law principles.

14. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.
